Gachagua Threatens to Sue Firm Over Ksh25M Nairobi Apartment Allegations

Rigathi Gachagua has threatened to take legal action against a company that accused him of moving a female associate into a luxury apartment without paying Ksh25 million for it.

Through his lawyers, Gachagua dismissed the claims as false and defamatory, saying he had never interacted with the company, visited the property or been involved in the alleged transaction.

In a demand letter, his lawyers asked the company to issue an unconditional retraction and publish a public apology in at least two national newspapers. The letter gave the company 24 hours to comply, warning that failure to do so would result in a defamation suit being filed immediately.

The row started after the company, through its lawyers, accused Gachagua and the alleged associate of illegal occupation of the apartment and demanded they be evicted. The company also sought admission of liability and payment of amounts said to have accrued and warned that failure to comply would force them to enforce their client’s rights – including auctioning items in the property.

Gachagua’s lawyers described the allegations as sensational, reckless and baseless. They said the claims, which were widely circulated on social and mainstream media, had incited public anger and caused serious damage to Gachagua’s personal, social and political reputation.

“You made these statements knowing they were false and unsubstantiated with total disregard for the truth,” part of the demand letter read.

The lawyers said the company’s conduct is defamatory under the Defamation Act (Cap 36) and contravenes Article 33(3) of the Constitution which limits freedom of expression where it undermines the reputation and rights of others.

This is the latest controversy to hit the former Deputy President who has been accused of working secretly with President William Ruto – a claim that has unsettled the United Opposition as the 2027 election approaches.
