High Court Directs DCI to Safeguard Evidence in Samidoh Rape Allegations
The High Court in Nairobi has ordered the DCI to preserve all forensic materials related to the sexual assault allegations against Mugithi star Samuel Muchoki, popularly known as Samidoh.
In temporary orders issued on Thursday, September 4, Justice Lawrence Mugambi directed the investigators to secure all documentary, digital and electronic evidence in the case and serve preservation notices to all relevant custodians to prevent tampering or loss of evidence.
“Until this petition is heard, all evidence connected to the complaint must be preserved,” Justice Mugambi ruled.
The court also barred Samidoh from having any contact with the complainant, M.R.W., or her witnesses. The orders prohibit the artist, his associates or agents from harassing, intimidating or interfering with the woman during the case.
Additionally, the judge directed that the complainant’s identity be kept confidential and all official documents be redacted and sealed to protect her privacy. The petition must be served to the respondents or through a widely circulated newspaper within seven days.
Once served, the respondents have one week to respond, the judge added, warning that any breach of the court’s orders will attract penalties.
The petition before the High Court is based on allegations that Samidoh sexually assaulted the complainant who told the court she has evidence such as audio recordings and electronic messages to support her claims.
