Tourists Issued Fresh Warning as Kenya Cracks Down on Unlicensed Operators Amid Safety Debate
The Tourism Regulatory Authority (TRA) has issued a fresh warning to both local and international tourists, urging them to avoid dealing with unlicensed tourism operators as Kenya moves to protect visitors from fraud, poor-quality services and illegal businesses during the peak travel season.
In a public advisory issued on Wednesday, July 22, the regulator called on travellers, hotels, tour operators, online travel platforms and tourist transport providers to verify the licensing status of tourism businesses before making payments or entering into commercial agreements.
The warning comes as Kenya prepares for one of its busiest tourism periods, with authorities seeking to safeguard the country’s reputation as one of Africa’s leading travel destinations.
“As Kenya enters the peak tourism season, the TRA reminds stakeholders and the public to engage only tourism enterprises holding a valid TRA licence,” the Authority said.
The regulator stressed that every tourism enterprise has a legal obligation to confirm that its business partners possess valid licences before making payments, referrals or signing contracts.
TRA particularly warned licensed businesses against paying commissions or referral fees to unlicensed operators, saying such transactions violate the Tourism Act, 2011.
“In particular, no TRA-licensed tourism enterprise should pay commissions, referral fees or any other form of remuneration to a person or entity required to be licensed under the Tourism Act, 2011, unless they hold a valid TRA licence,” the Authority stated.
The regulator further instructed hotels, travel agencies, transport providers and other licensed tourism businesses to insist on seeing a valid TRA licence before processing commission payments or referrals.
According to the Authority, businesses should also verify that the licence presented is genuine, current and belongs to the enterprise claiming ownership.
TRA warned that dealing with unlicensed operators not only breaches Kenya’s tourism regulations but also exposes travellers to scams, financial losses and poor service standards.
“Such operations undermine compliant businesses, expose visitors and enterprises to fraud and substandard services, and damage Kenya’s reputation as a safe and high-quality tourism destination,” the Authority warned.
To help travellers and industry players avoid falling victim to fraudulent operators, TRA encouraged anyone unsure about a company’s licensing status to contact the Authority for verification before making payments or completing bookings.
Warning Comes Amid Heated Political Debate
The advisory comes at a time when Kenya’s tourism industry has found itself at the centre of political debate following remarks attributed to former Deputy President Rigathi Gachagua.
Gachagua reportedly advised foreign tourists and investors to postpone visits to Kenya until after the 2027 General Election, claiming the country was experiencing political instability.
The comments triggered criticism from tourism stakeholders, who argued that such statements could undermine years of international marketing efforts aimed at positioning Kenya as a premier tourism destination.
In response, the Kenya Tourism Federation (KTF) rejected claims that Kenya is unsafe, maintaining that the country continues to welcome millions of visitors every year.
The federation noted that although every Kenyan enjoys the constitutional right to express personal opinions, statements portraying the country as insecure could have significant economic consequences for an industry that supports hundreds of thousands of jobs and generates billions of shillings annually.
The latest advisory from TRA is therefore expected to reinforce confidence in Kenya’s tourism sector by encouraging visitors and businesses to deal only with licensed operators while protecting the country’s reputation as a safe, reliable and high-quality travel destination.
