TSC Ban, Life Imprisonment Among Legal Risks Facing Alliance Girls’ School Teacher Over Decades-Old Abuse Claims.

A teacher at Alliance Girls’ High School is facing severe legal and professional consequences after revelations of alleged sexual exploitation over two decades. The matter has escalated after Africa Uncensored released an exposé The Teacher and the System which had former students and staff accusing the teacher of manipulating and exploiting minors under the guise of Christian Union mentorship.

Legal expert Danstan Omari during a TV legal show outlined the legal provisions if the victims file complaints and the teacher is arrested and charged. Omari said under Kenyan law there is no statute of limitation for sexual offences.

“Even if the acts happened in 1930 as long as the suspect is alive and the evidence is sufficient, criminal liability still stands,” Omari said.

Omari said the allegations fall under multiple sections of the Sexual Offences Act. Under Section 8 which deals with defilement of minors aged 16 to 18 years, the sentence is a minimum of 15 years imprisonment. Section 6 deals with compelling or inducing indecent acts and carries a sentence of not less than 5 years imprisonment and potentially life imprisonment. Section 11 prescribes a minimum sentence of 10 years imprisonment for indecent acts against minors.

Omari also cited Section 24 of the Act which imposes higher liability on individuals in positions of authority or trust including teachers. “A teacher is entrusted with the welfare of their students. If sexual advances were made under that trust, the law says not less than 10 years imprisonment,” Omari noted.

In cases where medical investigations confirm a disease was transmitted through the alleged conduct, the minimum sentence is 15 years and life imprisonment in aggravated circumstances.

Besides criminal sanctions, Omari said the teacher will face immediate professional consequences upon conviction. The Teachers Service Commission (TSC) can institute disciplinary proceedings that will ban the individual from teaching in any public or private institution.

Omari said a conviction will also disqualify the individual from getting a certificate of good conduct and engaging in any occupation involving minors.Education PS Julius Bitok has asked for the teacher to be arrested.

As of now the teacher is still at large. The exposé has sparked outrage with Alliance Girls’ High School alumni protesting at the school on Friday demanding action.
