Court Halts Construction of Gitaru Link Road Pending Hearing

The Environment and Land Court has stopped construction of a key link road between the Nakuru–Nairobi highway and the Western Bypass in Gitaru, Kiambu County, pending further orders.

The court issued the orders after residents told the court that the ongoing works had cut off their homes and businesses from direct highway access. They said concrete barriers erected by the Kenya National Highways Authority (KeNHA) to manage traffic and protect workers had forced them to use an 800-metre detour.

“That pending the inter-partes hearing of this application, a temporary injunction be issued restraining the respondents, contractors and agents from further development or commissioning for use of the road linking Nakuru–Nairobi Highway A104 and the Western Bypass abutting the petitioners’ properties in Gitaru,” the court ruled.

According to court papers, KeNHA started heavy excavation works in September 2025 and the petitioners’ land was elevated about 5-7 metres above the new road level. This has made it impossible to access their properties by car or even on foot.

“The petitioners are now forced to climb steep slopes to reach their properties, a health and safety risk,” the court heard.

The affected residents also raised safety concerns, saying once the project is complete the high-speed road will mainly be used by heavy trucks using the A104 highway and the Gitaru interchange. They said the absence of a service lane or slip road has devalued their properties.

The petitioners also accused KeNHA of starting the project without public participation, saying their grievances had been ignored despite repeated complaints.

The case will be heard on November 11, 2025.
