Former MP Arrested in Alleged Ksh6.4 Million Land Scam as DCI Uncovers ‘Double Role’ Deal

Former Mathioya Member of Parliament Francis Njakwe Githiari has been arrested by detectives from the Directorate of Criminal Investigations over allegations of fraud linked to a controversial land deal worth millions of shillings.

The former legislator was arrested on Thursday, May 14, at his Karen residence following investigations into an alleged scheme in which a couple reportedly lost Ksh6.4 million while attempting to purchase land and build a home in Ngong.

According to detectives, the couple had entered into an agreement with Githiari for the acquisition of a parcel of land alongside the construction of a double-storey residential house. Investigators claim the former MP acted both as the seller of the property and the contractor overseeing the proposed development.

The entire project was reportedly valued at Ksh40 million, with payments expected to be made in phases. Authorities say the couple transferred an initial Ksh6.4 million into Githiari’s account as part of the agreement before suspicions began to emerge.

Trouble reportedly started when the buyers conducted routine visits to the site and discovered disputes over the ownership of the land. It is alleged that other individuals had already laid claim to the same property, triggering fears that the transaction may have been fraudulent.

The discovery prompted the couple to halt any further payments before reporting the matter to investigators.

Detectives attached to the Land Fraud Investigation Unit subsequently launched investigations and are said to have established that the money had allegedly been obtained through false pretences.

“After review, the ODPP recommended Githiari be charged with the offence of obtaining money by false pretences, contrary to Section 313 of the Penal Code,” detectives stated.

The case file was forwarded to the Office of the Director of Public Prosecutions, which approved criminal charges against the former lawmaker.

Githiari is currently being processed by detectives and is expected to be arraigned before the Milimani Law Courts on May 15, 2026.

The arrest comes amid increasing scrutiny over land fraud cases in Kenya, with authorities repeatedly warning members of the public to exercise caution when entering high-value property transactions.

The DCI has urged Kenyans to report suspected land fraud and related criminal activities anonymously through its toll-free hotline and official WhatsApp reporting channels.
