DPP Renson Ingonga Orders IPOA to Expedite Probe into Death of Albert Ojwang in Police Custody

Director of Public Prosecutions (DPP) Renson Ingonga has directed the Independent Policing Oversight Authority (IPOA) to hasten its investigation into the death of Albert Ojwang and submit its report within seven days.

In a statement released on Tuesday evening, 27 May 2025, DPP Ingonga invoked his constitutional obligation under Article 157(4) and Section 5(2) of the Office of the Director of Public Prosecutions Act to express the urgency of the matter in invoking heightened public interest.

Ojwang died in police custody after he was arrested over a alleged false publication involving Deputy Inspector General of Police Eliud Lagat. Police initially said he had killed himself by hitting his head against a wall several times. But an autopsy conducted on Tuesday contradicted this claim, showing that Ojwang was assaulted and had multiple injuries on his body.

“In view of the above and pursuant to Article 157(4) of the Constitution and Section 5 (2) of the Office of the Director of Public Prosecutions Act, Cap. 6B of the Laws of Kenya, the DPP has directed IPOA to expedite the said investigations. The file should be submitted to the DPP within 7 days for review and necessary action,” the statement read.

IPOA had earlier announced on June 9, 2025 that it had started investigating Ojwang’s death. The DPP’s directive now puts more pressure on the oversight body to deliver its findings fast.

“The ODPP will continue to discharge its constitutional mandate in accordance with the law, public interest and administration of justice,” added the statement.

Ojwang’s death has sparked calls for accountability and transparency in police conduct. The IPOA’s report will be key in determining the next course of action and ensuring those who are found culpable are held responsible.
